The Services provide self-assessment tools and informational content intended to support self-reflection and general understanding. The Services do not provide medical, psychological, legal, or other professional advice, and are not designed to diagnose, treat, cure, or prevent any condition. You should not use the Services for clinical or other high-stakes decisions. If you have concerns, consult a qualified professional.

You may use the Services only if you are at least 16 years old and have the legal capacity to enter into a binding contract under applicable law. If you are under 18 (or the age of majority where you live), you may use the Services only with the involvement and consent of a parent/guardian.

4.1 Account creation. Some features require you to create an Account and provide accurate, complete, and up-to-date information.

4.2 Security. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your Account. Notify us promptly at hello@persotests.com if you suspect unauthorized access.

4.3 Suspension/termination. We may suspend or terminate your Account and access to the Services if we reasonably believe you violated these Terms or applicable law.

5.1 Personal use license. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use.

5.2 Service changes. We may update, modify, suspend, or discontinue any part of the Services (including Tests, scoring, features, or Content) to improve functionality, comply with law, or maintain security. Where a change materially impacts paid access, we will act reasonably and consistent with applicable consumer law.

7.1 Our IP. The Services and Content (excluding User Content, if any) are owned by or licensed to the Company and are protected by intellectual property laws. All rights not expressly granted are reserved.

7.2 No assignment. Except for the limited license in Section 5, nothing in these Terms transfers ownership of any intellectual property rights to you.

If the Services allow you to submit content (e.g., messages, feedback, or other materials) ("User Content"), you retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free license to host, use, reproduce, and display User Content only as needed to operate, improve, and secure the Services and to provide customer support.

You represent that you have all rights necessary to provide User Content and that it does not infringe third-party rights or violate law.

9.1 Subscription Terms. Subscriptions are also governed by our Subscription Terms (published separately and incorporated by reference). If there is a conflict, the Subscription Terms control for subscription-specific topics.

9.2 Auto-renewal. Unless you cancel before the end of the then-current billing period, your Subscription will automatically renew for the same period (e.g., monthly or annually, as selected at checkout), and we will charge the payment method you provided.

9.3 Free trials (if offered). If we offer a free trial, it converts into a paid Subscription unless cancelled before the end of the trial period shown at checkout. Where required by law, we will obtain your express consent for the trial conversion and auto-renewal.

9.4 Pricing and taxes. Prices are shown at checkout. Taxes may apply depending on your location and applicable law.

9.5 Cancellation. You can cancel your Subscription using the cancellation functionality available in your account (if enabled) or by contacting us at hello@persotests.com. If you request cancellation by email, the cancellation is effective when we confirm it by email. Cancellation stops future renewals; you typically retain access until the end of the current paid period.

9.6 Refunds. Refunds (if any) are handled according to mandatory consumer protection rules that apply to you and the specific rules shown at checkout and in the Subscription Terms.

If you are a Consumer in the EU/EEA/UK and you purchase digital content or digital services, you may have a statutory right to withdraw within 14 days from the conclusion of the contract. However, you may lose this right if you expressly request immediate performance and acknowledge that you will lose the right of withdrawal once performance begins, to the extent permitted by applicable law.

Where required, we will present the relevant disclosures and obtain the necessary consent and acknowledgment at checkout.

11.1 Privacy Policy. Our processing of personal data as a controller is described in our Privacy Policy (published separately and incorporated by reference).

11.2 Minimization. Please do not submit sensitive information through free-text fields unless expressly requested by the Services and supported by applicable law.

We may use third-party providers (e.g., payment processors, analytics, hosting). Their terms may apply to your use of their services. We are not responsible for third-party services outside our control, except as required by law.

To the maximum extent permitted by law, the Services are provided "as is" and "as available." We do not warrant that the Services will be uninterrupted, error-free, or that results will be accurate or suitable for any particular purpose.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for fraud or willful misconduct, and nothing affects your statutory rights as a Consumer.

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenues, goodwill, or data.

To the maximum extent permitted by law, our total liability arising out of or relating to the Services will not exceed the amount you paid to us in the 12 months prior to the event giving rise to the claim (or EUR 50 if you paid nothing), except where mandatory law requires otherwise.

To the extent permitted by applicable law, you agree to indemnify and hold us harmless from claims arising out of your unlawful use of the Services, your violation of these Terms, or your infringement of third-party rights. This does not apply where prohibited by consumer protection law.

You may stop using the Services at any time. We may suspend or terminate access as described in Section 4.3. Sections that by their nature should survive termination will survive.

These Terms are governed by the laws of Romania, without prejudice to mandatory consumer protections that apply in your country of residence.

If you are a Consumer in the EU/EEA/UK, you may bring claims in the courts of your habitual residence where permitted by applicable law. Otherwise, disputes shall be subject to the competent courts of Bucharest, Romania.

We may modify or update these Terms at any time, for example to reflect changes to the Services, our business practices, legal requirements, or security needs. Updated Terms will be posted on the Services and will apply from the "Last updated" date (or a later effective date stated in the updated Terms).

If the changes are material, we will take reasonable steps to provide additional notice (for example by email or an in-product notice).

By continuing to access or use the Services after the updated Terms become effective, you agree to the updated Terms. If you do not agree, you must stop using the Services and, if applicable, cancel your Subscription.

We may send notices to you via email, your Account, or on-site notifications.

20.1 Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

20.2 Assignment. We may assign or transfer these Terms (including in connection with a merger, acquisition, or sale of assets). You may not assign these Terms without our prior written consent, except where mandatory law provides otherwise.

20.3 Force majeure. We are not liable for delays or failures due to causes beyond our reasonable control (e.g., internet outages, acts of government, labor disputes, or force majeure events).

20.4 Entire agreement. These Terms, together with the Subscription Terms and Privacy Policy, form the entire agreement between you and us regarding the Services and supersede prior agreements on the same subject.

20.5 Language. If we provide these Terms in multiple languages and there is a conflict, the version designated on the Services as controlling will prevail, to the extent permitted by law.
